Hearing Officer: Jerry Parkin OPENING: 7:00 pm Ladies and Gentlemen, I call this hearing to order. My name is Jerry Parkin. I represent the Utah Solid and Hazardous Waste Control Board and have been appointed by the Executive Secretary of the Board as the hearing officer. This is a hearing to receive public comment on a request to incorporate a Class 3 Modification into the Thiokol Hazardous Waste Storage Permit. The permit was originally issued on September 28, 1992. Thiokol conducted a public meeting on the request for the modification on March 22, 1995. This permit concems the storage and treatment of hazardous waste resulting from the manufacture of solid propellent rocket motors and conventional munitions at the Thiokol Facility located in Box Elder County, Utah. If approved, this permit modification would allow Thiokol to incorporate the permit modification into its Hazardous Waste Storage Permit. This hearing is being held under the authority of Title 19, Chapter 6, Section 104 of the Utah Code Annotated, 1953 as amended. The public notice for this hearing and the associated public comment period was published in the May 15, 1995 edition of the Box Elder News Joumal , The Logan Herald Joumal , Salt Lake Tribune, and the Deseret News. Additionally, notice of this hearing was mailed on May 11, 1995 to members of the public who in the past have indicated a desire to be notified of such activities and was broadcast on KSL radio on June 7, 1995. The public comment period for this Class 3 Modification request began on May 15, 1995 and will conclude on June 29, 1995. Copies of the Class 3 permit modification have been and are available for examination and public review at: the office of the Division of Solid and Hazardous Waste, 288 North 1460 West, Salt Lake City, Utah; the Brigham City Library, 26 East Forest Street, Brigham City, Utah; and the Logan City Public Library, 225 North Main, Logan Utah. Opportunity will be provided to any person desiring to participate in this hearing. Written comments conceming the Class 3 Modification to the Thiokol Hazardous Waste Storage Permit will be received no later than 5:00 P.M., June 29, 1995 and accepted for the record. If anyone desires to make an oral conmient at this hearing, please indicate so on the attendance list. These proceedmgs are being recorded and a transcript of these proceedings will be available for public inspection at the Division of Solid and Hazardous Waste, 4th Floor of the Martha Hughes Cannon Health Building. This is an administrative hearing and as such there will be no cross examination of any participants. Those who have questions or comments to make should state their names and direct their questions or comments to me. I ask that you confine your remarks to the Class 3 Permit Modification request and related issues and limit your remarks to 10 minutes or less. Comments that are not pertinent may be ruled out of order. It is the policy of the Department of Environmental Quality that this hearing remain in session for at least one hour. If, during that hour, there comes a time when there is no one desiring to make a comment or ask a question, the hearing will be recessed. At the end of the hour or when there is an indication that someone would like to make a comment or ask a question, the hearing will be reconvened and the record reopened. This hearing will then be concluded after all those who desire to make a comment have done so. This hearing is now open for public comment. COMMENTS: Mr. Craig Holmgren made the following statement. "I would like to understand more about what they are domg out there. One inch crate....operate a ranch. And we've had trouble with tablets laymg out on the ground....bum it...whatever went out through the smoke plume... waste dump...I didn't know that there was a thing out there to review. Another question is... At this time..." At this time Mr. Parkin passed a copy of the proposed Class 3 Modification to Mr. Holmgren as it was apparent that he had not seen it. Mr. Parkin noted that the modification only effected storage not open burn/ open detonation . "Have you read through this? Is there anything in here...this is the permit? This is just an amendment to a permit for storage? Well that's..as long as they don't tear up more ground to build more storage buildings. Is the facilities there to store it now? It is a liquid?" At the conclusion of Mr. Holmgren comments they were played back and it was noted that Mr. Holmgren's comments were not recorded completely. The recorder only functioned intermittently. The gaps are noted in the transcript with three dots or periods (...). The gentleman was asked to repeat his statement with the recorder closer to him. His comments follow. "I would rather communicate one on one with someone who knows what's going on than with a whole room of people. I know, I've worked with one guy a lot. I can't remember his name. Who is Wallace? This is just storage. We're more concemed with the on plant buming. That's fine I guess I know what it is for. I'm through."
