Dear Mr. McQuivey:
Enclosed is the RCRA emergency permit for operation of four
Subpart X miscellaneous units (vessels). The emergency permit is
being issued for the management of the reactive (D003) hazardous
waste currently being disposed in twelve (12) M-136 area surface
impoundments and described in Morton Thiokol's October 25 and
November 3, 1988, submittals.
As Morton Thiokol is aware, Section 3005(j) of RCRA, as
amended by the Hazardous and Solid Waste Amendments of 1984
(HSWA), prohibits the operation of the 12 surface impoundments
after November 8, 1988, as currently constructed. On October 25,
1988, EPA denied the interim status for these surface
impoundments. Since emergency permits are limited to ninety (90)
days under 40 C.F.R. Sec. 270.61, subsequent emergency permits
will be issued, provided that all permit terms and conditions are
met. The emergency permits are only to assist Morton Thiokol
from November 8, 1988, through May 31, 1989, to manage its
reactive wastes. The company has committed to the Utah
Department of Health (UDH) to provide by June 1, 1989, an
operational treatment system for the r~~ctiv~ hazardous
wastewaters. The treatment system wiLl pro·.j ide a permanent
technique for handling the hazardous waste curre~Lly disposed in
the surface impoundments.
This permit is effective for 25 days, expiring on
December 2, 1988. During this 25-day period a more comprehensive
emergency perrnit~~i1l be subsequently developed and issued for
continued operatim·i·c:lnd·-ci'Os'\lre· of the vessels. This permit will
be based on the information submitted by Morton Thiokol and
