Notice of Intent – Cache County
Your Notice of Intent dated June 14, 2024, to relocate portable generators to the temporary project
for the Hyrum facility, located at 410 North 800 East, Hyrum, UT, was received by the Utah
Division of Air Quality (DAQ) and has been reviewed.
The following equipment has been approved for operation for this temporary project:
Two (2) Cat C27 2014 725 kW generators
The State of Utah has permitted the portable generators for Kilgore Contracting, LLC on the
Approval Order (AO) DAQE-AN129310019-18, dated April 12, 2018. The above relocation
address is a permitted aggregate facility with established emission and production limits as per the
AO DAQE-100550003-20, dated September 15, 2020. The operation of the generators shall be in
compliance with the portable AO’s stationary diesel-fired engine Conditions II.B.10.a through
II.B.10.c.1. Condition II.B.3.c of this AO restricts the operation of all portable equipment to the
hours of 6:00 am to 10:00 pm.
Approval is granted to relocate and operate this equipment at the new location for a period not to
exceed 180 operational days.
The owner/operator shall maintain records of the actual operation hours, days, and production
rate, of the above referenced equipment at this relocation site and have the ability to submit the
information to the DAQ upon the request of representatives of the director. Please make certain
that the plant operator is aware of all the location specific requirements for this site and the
conditions of the aforementioned AO.

Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary
project. Please refer to Utah DEQ Water Quality’s current Storm Water Construction
requirements for additional information.
This approval for relocation in no way releases the owner or operator from any liability for
compliance with all other applicable federal, state, and local regulations including the UAC.

Susan,
I just wanted to add some clarification to our request to use generators at our Hyrum pit, as we just submitted a TRP
application online. Unfortunately, we don’t have access to line power through the city that we need in order to run some of
our aggregate processing equipment at that site. We are not sure when we might have access to the amount of electricity
we would need to run all our equipment, so for now we are requesting a TRP in order to add two generators to the site.
Adding these generators is a temporary solution and we will be in communication with both the city along with the
consulting team we work with to modify and evaluate air quality permits so we can find a permanent solution to this
situation.
As a reminder this is in reference to TRP # C-189-24 for the following equipment to be used at our Hyrum site in Cache
County:
