Dear Messers Jassal and Poursaid (for XpressMart, LLC, & Esfahan, LLC):
The Utah Underground Storage Tank Act (Act), Utah Code Ann. § 19-6-414, provides that
the Division Director may revoke a certificate of compliance if it is determined that the requirements
specified in Utah Code Ann. §§ 19-6-412(2), 413 are not current. Utah Code Ann. § 19-6-412(2)(c)
requires substantial compliance with all State and Federal statutes, rules, and regulations including
Utah Admin. Code R311-202-1, which incorporates by reference 40 CFR § 280.
At the request of the Division Director, the Division of Environmental Response and
Remediation (DERR) performed an inspection of your facility and a compliance review for the
Facility ID# 4000973

certificate of compliance issued to a facility owned or operated by XpressMart, LLC, & Esfahan,
LLC, and/or Tajinder S. Jassal (you). This facility is located at 2729 West 9000 South, West Jordan,
Utah. The designated Facility Identification Number is 4000973. This facility contains four
underground storage tanks.
The compliance review indicates that you have not satisfied the requirements of the
certificate of compliance. You were sent a Notice of Non-Compliance on September 8, 2023,
explaining what you must do to be in compliance, and you failed to respond. You were then sent a
Notice of Violation and Order to Comply (Order) on March 14, 2024, which found that you remain
in violation of the Act and ordered you to take certain steps to come into compliance. You did not
comply with or contest the Order. The Order is now a final Agency Order. Now that you were found
to be in violation of the eligibility requirements for the Petroleum Storage Tank (PST) Fund your
certificate of compliance may be revoked. You may still achieve compliance, but you must do the
following:
1. Submit to the DERR documentation that the submersible turbine pump piping
connectors at tanks #1, #2, #3, and #4 are protected from corrosion.
You have 60 days following the receipt of this letter to demonstrate that you have brought
your facility back into compliance with the requirements of the Act or an Order Revoking the
Certificate of Compliance will be issued. If your certificate of compliance is revoked, you will be
ineligible to receive deliveries of fuel. Also, if you are participating in the Environmental Assurance
Program and your certificate of compliance is revoked, you will be violating the eligibility
requirements for participation in the PST Fund, and you will be ineligible to receive payment for
claims against the PST Fund.

Notice at your earliest convenience. In addition, if you believe that this Notice has been sent to you
in error or that you are in compliance with the eligibility requirements, please submit a written
response setting forth the applicable facts to the DERR. Please reference the Facility Identification
Number in your correspondence.
