Your Notice of Intent dated May 20, 2024, to relocate portable asphalt equipment to the temporary
project located north of the intersection of Spring Creek and US Highway 91, 10 miles north of Dutch
John, UT, was received by the Utah Division of Air Quality (DAQ) and has been reviewed.
The following equipment has been approved for operation for this temporary project:
E300 drum asphalt plant
CEI hot oil Trailer
70 kva generator
900 kW generator
The referenced asphalt plant has been permitted for operation in the State of Utah by the portable
Approval Order (AO) originally issued to Burdick Paving DAQE-AN0113570006-09, dated
October 26, 2009. The referenced generator has been permitted by the Staker Parson Companies AO
DAQE-AN115180014-15, dated July 6, 2015. Approval is granted to relocate and operate this
equipment at the new location for a period not to exceed 180 operational days. As per Utah
Administrative Code (UAC) R307-401-17, the operation of equipment at this temporary site may be
for up to 180 working days in any calendar year not to exceed 365 consecutive days, starting from the
initial relocation date. The above referenced asphalt plant must test within 180 days of the startup of
the plant. Condition II.B.9.e.1 of DAQE-AN0113570006-09, permitting the asphalt plant establishes
the stack testing requirements of this equipment. The procedures stated in II.B.9 .e.5 must be followed
if the maximum AO allowable production rate has not been achieved at the time of the test. It is
important to be aware that as per Condition II.B.9.e.2, a testing protocol shall be submitted to the
DAQ for review and approval at least 30 days prior to conducting the stack test.

Approval is subject to the conditions of the dust control plan submitted for this location and the
applicable conditions of the above referenced AOs. Hours of operation shall be held to 16 hours per
each 24-hour day. The maximum production rate shall be held to the requested 400 tons per hour.
Emissions for this project have been estimated at the following:

The owner/operator shall maintain records of the actual operation hours, days, and production rate, of
the above referenced equipment at this relocation site and have the ability to submit the information to
the DAQ upon the request of representatives of the Director. Please make certain that the plant
operator is aware of all the location specific requirements for this site and the conditions of the
aforementioned AO.
Utah Division of Water Quality Storm Water Permits and regulations may apply to this temporary
project. Please refer to Utah DEQ Water Quality’s current Storm Water construction requirements for
additional information.
This approval for relocation in no way releases the owner or operator from any liability for compliance
with all other applicable federal, state, and local regulations including the UAC.

As stated on the voicemail I left this morning, the DAQ is requiring that all portable asphalt plants stack test within 180
days of the startup of the equipment regardless of whether the plant achieves 90% production of the design capacity. The
procedures for stack testing in these lower production situations are stated on Condition II.B.9.e.5 of the attached portable
AO that was referenced on your electronic TRP request.
Also - can you provide the generator size for the diesel engine listed as item 4 of this submission? Thanks, let me know if
you have any questions.
