Re: Approval - Big West Oil, LLC,40 CFR 63 Subpart CC and UAC R307-327-5, Davis County
On April 8,2024, the Utah Division of Air Quality (DAQ) received a request to align 40 CFR 63.655(h)(2)
and 40 CFR 63.1066(bXl) notification requirements with the 7-day notification timeline of
UAC R307-327-5(5). The request is a blanket waiver-and-replacement request for all future 30-day Croup
I storage tank refill notifications required by 40 CFR 63.655(h)(2)(i) to be replaced by 7-day refill
notifications required by UAC P.307-327-5(5), and for all future 30-day inspection notifications required
by 40 CFR 63.655(h)(2)(ii) and 40 CFR 63.1066(bXl ) to be modified to a7-day notification requirement.
Your request is approved as allowed by 40 CFR 63.655(h)(2)(C) and 40 CFR 60.1066(bXl), granted all
7-day notifications contain all information required by 40 CFR 63.655(h) and/or 40 CFR 60.1066(bXl).
Furthermore, in the event the 7-day tank refill notification of UAC R307-327-5(5) is repealed or replaced,
this waiver of 40 CFR 63.655(hx2)(i), and modification to 40 CFR 63.655(hx2)(ii) and
40 CFR 60. 1066(bX I ), is rescinded and reporting requirements will revert back to the requirements of
40 CFR 63.655(h) and40 CFR 60.1066(bXl).

approval to submit storage vessel refill and inspection notifications for all Group I storage
vessels subject to 40 CFR 63 Subparts CC/WW in accordance with the 7-day storage vessel refill
notification timeline required by Utah R307-327-5(5) since this rule is also applicable to all
Group I storage vessels.
