On April 24,2024, a representative of the Utah Division of Air Quality (DAQ) conducted an
inspection of Weber State University located at l4l0 Edvalson Street, Ogden, UT 84408. The
DAQ observed that generator maintenance and testing operations may be in violation of
Conditions I.2, II.B.3.d, [[.8.3.e, and II.B.3.f of AO DAQE-AN122800007-18, dated December 7,
2018.
Weber State University is required to comply with the above regulations. A written response to
this letter is required within ten (10) business days of receipt of this letter.

Potential Violation(s)
On April 24,2024, an inspector fiom the DAQ observed Weber State University located at
l4l0 Edvalson Street, Ogden, UT 84408.
At the time of the inspection the DAQ documented the following potential violations:
generator maintenance and testing has taken place before 9 am and/or after 5 pm, longer than
30 minutes, and at greater than25o/o of max engine [oad.

AO Conditions/Rules
DAQE-122800008-18 Condition I.2 states:
The limit.s setforth in this AO shall not be exceeded without prior approval. [R307-401J
DAQE-122800008-18 Condition II.B.3.d states:
The owner/operator shall conduc't maintenance and testing operations between 9:00 AM and
5:00 PM only. [R307-410]
DAQE-122800008-18 Condition II.B.3.e states:
The owner/operator shall conduct maintenance and testing runs no longer than 30 minutes per
day, per engine. [R307-410J
DAQE-l22800008-18 Condition II.B.3.f states:
The owner/operator shall condttct maintenance and testing operation at no greater than 2596
of max engine load. [R307-410J
The purpose of a Compliance Advisory (CA) is to document observations made by the DAQ. You
are responsible for complying with the Utah Air Conservation Rules. There are possible
administrative and civil penalties for failing to do so. Section l9-2-l l5 of the Utah Code
Annotated provides that violators of the Utah Air Conservation Act and/or any order issued there
under may be subject to a civil penalty of up to $ 10,000 per day for each violation.
The written response to this CA will be considered in resolving the deficiencies documented in
this letter. It may include information demonstrating compliance with the regulations or a
schedule to bring your company back into compliance with the applicable regulations. The DAQ
will review your response and this CA may be revised as a result of that review. Failure to
respond in writing within ten (10) business days of receipt of this CA willbe considered in any
subsequent enforcement action and the assessment of penalties.

Possible DAQ actions to resolve a CA include: No Further Action Letter, Warning Letter, Early
Administrative Settlement with reduced civil penalty, Settlement Agreement with civil penalty, or
Notice of Violation and Order to Comply.
This CA does not limit or preclude the DAQ from pursuing enforcement options concerning this
inspection. Also, this CA does not constitute a bar to enforcement action for conditions that the
DAQ did not observe or evaluate, or any other conditions found during future inspections.
