Re: The RCRA regulations that apply to the underground hazardous waste tank at Sorenco.
Thank you for coming in to talk to David McCleary and Jim Lansbarkis of my staff on March
2t, L99l about your underground hazardous waste storage tank. You indicated in the meeting
that hazardous wastes have routinely been placed in the tank and that the tank is also functioning
as secondary containment for your processes that use ignitable materials. Therefore, the
regulations that you need to comply with concerning this tank are those dealing with generators
of hazardous waste found in R450-5 and those dealing with tanks in R450-7-17 of the Utah
Administrative Code. These are also listed in 40 CFR (Code of Federal Regulations) part262
for generators and part265 Subpart I for tanks. Please review these pertinent regulations and
inform the Bureau by April 27, l99l if the tank will be removed from future service or
upgraded to meet the requirements of the regulations. Questions may be directed to Jim
