Past verification investigations concluded that the referenced ORA soil piles have not adversely impacted the underlying native soil and that the soil piles are not characteristically hazardous. A risk assessment was performed to assess the risks to construction workers, indoor workers, outdoor workers and maintenance workers. The results from the risk assessment indicate that the soil piles are safe for commercial and industrial land use and can be used as fill material beneath roads, parking lots and embankments. The notification letter proposed the use of the ORA soil piles as fill material for the construction of a road and embankment for an overpass of Center Street. The overpass will span Vineyard Road and the Union Pacific Railroad. The use of the ORA soil piles as fill material for Vineyard City’s Center Street and associated ramp/embankment will require the submittal and approval of an Environmental Covenant and Site Management Plan, for the locations where the ORA soil piles will be placed. The submittal of a draft Environmental Covenant and draft Site Management Plan should occur once the placement of ORA material is complete. The proposed use of the ORA soil piles is hereby approved. Should it be necessary or anticipated that ORA material will be temporarily staged before final placement, a work plan detailing the proposed work activities should be submitted for approval. The work plan should identify the location where the soil pile will be staged, as well as how confirmation will be performed, verifying that all ORA material was removed from the staged location.
