RE: Approval of Response to Comments and Request for No Further Investigation Pepper River Project (Former Fairchild Semiconductor Facility) 3333West 9000 South, West Jordan, Utah

Dear Mr. Downey: The Division of Waste Management and Radiation Control has completed its review of the response to comments on the Investigation Activities Report. The investigation was conducted to characterize the
environmental conditions at the Former Fairchild Semiconductor Property and to provide additional data
in support of a request for a no further investigation designation at the site. Based on the review, the Division concludes that the response to comments addresses all of our comments. Requested information has also been provided. The Division also concurs with the
conclusions of the investigation report. The request for a no further investigation with controls at the site
is hereby approved. As documented in the investigation report, some portions of the property will require controls to be put in place to ensure the risk is consistent with intended land use. Please submit at your earliest convenience a draft Site Management Plan (SMP) that addresses the necessary site controls and also a
draft Environmental Covenant (EC) to be recorded on the property. (Over)
