The purpose of the physical protection requirements is to enhance control of certain radioactive material to reduce the risk of unauthorized use and malicious acts, through access controls to aid in the prevention, prompt detection, assessment and response to mitigate potentially high consequences that would be detrimental to public health and safety. 1.2 Scope This procedure applies to all EnergySolutions employees, subcontract personnel and individuals who have access to RAMQC that has been accepted or is under the control of EnergySolutions. 2 REFERENCES 2.1 US NRC 10CFR37, Physical Protection of Category 1 and Category 2 Quantities of Radioactive Material 2.2 US NRC 10CFR20, Energy. Subpart I, Storage and Control of Licensed Material 2.3 ES-MA-PR-008, Trustworthy & Reliable (T&R) Procedure 2.4 LLEAP, Local Law Enforcement Agency Plan 2.5 CL-SE-PR-001, Clive Facility Security Operations Protocol 3 GENERAL 3.1 Definitions 3.1.1 Approved Individual - an individual whom the licensee has determined to be trustworthy and reliable for unescorted access, having completed the training required by 10 CFR 37.43(c). 3.1.2 Escorted Access - accompaniment while in a security zone by an approved individual who maintains continuous direct visual surveillance at all times over an individual who is not approved for unescorted access. 3.1.3 Local Law Enforcement Agency (LLEA) - a public or private organization that has been approved by a federal, state, or local government to carry firearms and make arrests, and is authorized and has the capability to provide an armed response in the jurisdiction where the licensed category 1 or category 2 quantity of radioactive material is used, stored, or transported. 3.1.4 Need to Know — A determination by the General Manager, Clive Operations and Senior Vice President, Regulatory Affairs for the Non-Proprietary Page 3 of 17 Clive RAMQC CL-SE-PR-030 Revision 6 protection of sensitive and safeguard information such that an individual may have access to perform their necessary job functions to meet their duties of employment. 3.1.5 No-Later-Than Arrival Time - the date and time that the shipping licensee and receiving licensee have established as the time at which an investigation will be initiated if the shipment has not arrived at the receiving facility. The no-later-than arrival time may not be more than six (6) hours after the estimated arrival time for shipments of category 2 quantities of radioactive material. 3.1.6 RAMQC — Radioactive Material in quantities greater than or equal to the values as provided in Attachment 5.1 to this procedure. Quantities of Concern applies to the following: • A single container with an activity content greater than or equal to the values in Attachment 5.1. • Stored material with an aggregate activity content greater than or equal to the values in Attachment 5.1. 3.1.7 Reviewing Official - the individual who shall make the trustworthiness and reliability determination of an individual to determine whether the individual may have, or continue to have, unescorted access to the category 1 or category 2 quantities of radioactive materials that are possessed by the licensee. 3.1.8 Safe Haven - a readily recognizable and readily accessible site at which security is present or from which, in the event of an emergency, the transport crew can notify and wait for the local law enforcement authorities. 3.1.9 Security Zone - any temporary or permanent area determined and established by the licensee for the physical protection of category 1 or category 2 quantities of radioactive material. 3.1.10 Sensitive and Safeguard Information (SGI) — Detailed information generated by the licensee that describes the Radioactive Material and the specific controls for the physical protection of the material. 3.1.11 Trustworthy and Reliable (TR) — characteristics of an individual considered dependable in judgment, character, and performance, such that unescorted access to category 1 or category 2 quantities of radioactive material by that individual does not constitute an unreasonable risk to the public health and safety or security. A determination of trustworthiness and reliability for this purpose is based upon the results from a background investigation. 3.1.12 Unescorted Access - solitary access to an aggregated category 1 or category 2 quantity of radioactive material or the devices that contain the material. Non-Proprietary Page 4 of 17 Clive RAMQC CL-SE-PR-030 , Revision 6 3.2 Responsibilities 3.2.1 General Manager, Clive Facility (GM) is responsible for implementing this procedure and ensuring the proper project specific documents are generated as required which specify the RAMQC controls. The GM will work in conjunction with the Radiation Safety Officer and Senior Vice President, Regulatory Affairs to implement the RAMQC program and to ensure the proper RAMQC controls and security measures are considered. 3.2.2 Manager, Plant Administration (PA Manager) is responsible for security functions which include monitoring, immediately detecting, assessing and responding to unauthorized access to RAMQC. 3.2.3 Radiation Safety Officer (RSO), or designee, is responsible for implementing the Radiation Protection Program which includes the proper storage and control of Radioactive Material and for tracking the Radioactive Material inventory against the Radioactive Material license and as a result, any RAMQC. 3.2.4 Manager, Shipping & Receiving (S&R Manager) is responsible for notifying security when a RAMQC shipment is scheduled. Upon receipt of notification of a shipment of a category 2 quantity of radioactive material bound for Clive, the S&R Manager, or designee, is responsible to confirm receipt of the shipment with the originator. If the shipment has not arrived by the no-later-than arrival time, the S&R Manager shall notify the originator. 3.2.5 Senior Vice President, Regulatory Affairs (SVPRA) is responsible for approving the overall RAMQC program and working with the GM, PA Manager, and the RSO to ensure the program is properly implemented as required. 3.2.6 Reviewing Official is the only individual who may make trustworthiness and reliability determinations that allows individuals to have unescorted access to category 1 or category 2 quantities of radioactive materials possessed by the licensee. Reviewing Official must be permitted to have unescorted access to category 1 or category 2 quantities of radioactive materials or access to safeguards information or safeguards information- modified handling, if the licensee possesses safeguards information or safeguards information-modified handling. The Reviewing Official cannot approve other individuals to act as Reviewing Officials. The Reviewing Official shall determine whether to permit, deny, unfavorably terminate, maintain, or administratively withdraw an individual's unescorted access authorization based on an evaluation of all of the information collected. The Reviewing Official may not permit any individual to have unescorted access until the Reviewing Official has evaluated all of the information collected to meet the requirements and determined that the individual is trustworthy and reliable. The Reviewing Official may deny unescorted access to any individual based on information obtained at any time during Non-Proprietary Page 5 of 17 Clive RAMQC CL-SE-PR-030, Revision 6 the background investigation. The Reviewing Official may terminate or administratively withdraw an individual's unescorted access authorization based on information obtained after the background investigation has been completed and the individual granted unescorted access authorization. 3.2.7 Responsible managers are responsible for identifying the appropriate personnel who require access to SGI and unescorted access to RAMQC. They are also responsible for notifying the GM and RSO in writing of new T&R requests. 3.2.8 Trustworthy and Reliable Individual (T&R) — Each T&R individual shall complete security training before being allowed unescorted access to category 1 or category 2 quantities of radioactive material. Each T&R individual is responsible for reporting any unauthorized access to RAMQC. They are also responsible for reporting any condition or activities that may compromise their ability to be considered "trustworthy and reliable" to the GM such as an arrest or contact with a foreign national or suspect personnel. 3.3 Precautions and Limitations 3.3.1 The control of sensitive and safeguard information is addressed within § 37.103 of Reference 2.1. 3.3.2 Any project specific document(s) generated as a result of this procedure which contain any specifics regarding the Radioactive Material including radioisotopes and quantities, storage locations, transportation dates, carriers and routes, specific radioactive material controls and security measures shall be controlled as sensitive or safeguard information (SGI) in accordance with Reference 2.1. These records shall be maintained for the terms of Radioactive Material Licenses UT2300249 and UT2300478, unless otherwise stated. 3.3.3 This procedure applies only to the following; 3.3.3.1 Packaged material stored awaiting loading and transport with an aggregate RAMQC. 3.3.3.2 Equipment and devices with RAMQC which weigh less than 2,000 kg (4,409 lbs). 3.3.4 This procedure does not apply to a facility where the activity is spread across the site on building surfaces, installed equipment and systems and contaminated soil where the material cannot be easily removed for malicious purposes. 3.3.5 Trustworthy and reliable personnel shall be granted unescorted access only to the RAMQC and/or SGI required to perform their job functions. Unescorted access to controlled areas and SGI that is not required to perform their job functions shall be limited and or prohibited. Non-Proprietary Page 6 of 17 Clive RAMQC CL-SE-PR-030 Revision 6 3.4 Records 3.4.1 FBI Fingerprint Card 3.4.2 Background and Criminal History Check Questionnaire 4 REQUIREMENTS AND GUIDANCE Note: In the event of any actual attempted theft, sabotage or diversion of Radioactive Material or the theft of devices, the licensee shall promptly notify the NRC Operations Center at (301) 816-5100 following initial appropriate response and within four (4) hours after contacting the LLEA. 4.1 Access to RAMQC 4.1.1 The appropriate manager shall identify and submit a list of personnel with justification requiring unescorted access to RAMQC to the RSO and GM. 4.1.2 Prior to granting personnel unescorted access to RAMQC, that individual shall be determined to be "trustworthy and reliable" by the Reviewing Official. 4.1.3 Only those personnel who are deemed "trustworthy and reliable" and have a "need to know" as approved in writing by the Reviewing Official, shall have unescorted access to radioactive material and devices containing RAMQC. 4.1.4 Those personnel who require access to perform a job function or duty that have not been approved for unescorted access shall be escorted by an approved T&R individual at all times. 4.1.5 A list of all personnel approved for unescorted access to RAMQC shall be maintained by the Reviewing Official and forwarded in a secure manner to Document Control personnel for entry into the electronic document imaging system (OnBase). 4.1.6 Records of all personnel granted unescorted access including the dates access was granted and/or removed shall be maintained in accordance with record retention requirements. 4.2 Approval of "Trustworthy and Reliable" Personnel 4.2.1 A background investigation may not be initiated on any personnel seeking "Trustworthy and Reliable" status without the informed and signed consent of the subject individual. This consent must include authorization to share personal information with other individuals or organizations as necessary to complete the background investigation. Before a fmal adverse determination, the Reviewing Official shall provide the individual with an opportunity to correct any inaccurate or incomplete information that is developed during the background investigation. A signed consent must be obtained prior to any reinvestigation. Non-Proprietary Page 7 of 17 Clive RAMQC CL-SE-PR-030, Revision 6 4.2.2 If an individual withdraws his or her consent, the Reviewing Official may not initiate any elements of the background investigation that were not in progress at the time the individual withdrew his or her consent; and such withdrawal of consent for the background investigation is sufficient cause for denial or termination of unescorted access authorization. 4.2.3 Each individual designated for T&R status is to obtain a FBI fingerprint card from the PA Manager and make arrangements with the local law enforcement to complete the fmgerprinting process. 4.2.4 Submit the completed fingerprint card to the Reviewing Official. 4.2.5 A background and criminal history check shall be performed for each individual prior to obtaining unescorted access to RAMQC. Each individual designated for unescorted access shall obtain from, complete, and submit the background check questionnaire to the Reviewing Official. Refusal to provide, or the falsification of, any personal history information is sufficient cause for denial or termination of unescorted access. 4.2.6 Trustworthiness and reliability shall be determined, at a minimum, by reviewing the background check, criminal history check, verifying employment history, including military history, with each previous employer for the most recent seven (7) years before the date of application, education, and personal references. To the extent possible, obtain independent information to corroborate that provided by the employee (i.e., seeking references not supplied by the individual). 4.2.7 Service providers shall be escorted unless determined to be trustworthy and reliable by an NRC-required background investigation as an employee of a manufacturing and distribution (M&D) licensee. Written verification attesting to or certifying the person's trustworthiness and reliability shall be obtained from the manufacturing and distribution licensee providing the service. 4.2.8 The Reviewing Official shall document the basis for concluding there is reasonable assurance an individual is "trustworthy and reliable" and is being granted unescorted access to RAMQC. If an individual is determined to not be "trustworthy and reliable", that individual and the PA Manager will be notified by the Reviewing Official. 4.2.9 The GM shall notify the Reviewing Official when a current employee loses T&R Status and is not terminated by the Clive Facility. The Reviewing Official shall remove the employee from the T&R list and shall notify the applicable personnel to update the employee's badge. 4.2.10 The Reviewing Official shall conduct a reinvestigation every 10 years for any individual with unescorted access. The reinvestigation shall consist of fingerprinting and an FBI identification and criminal history records check in accordance with § 37.27. The reinvestigations must be completed within 10 years of the date on which these elements were last completed. Non-Proprietary Page 8 of 17 Clive RAMQC CL-SE-PR-030 Revision 6 4.3 Storage of RAMQC 4.3.1 To ensure the safe handling, use, and control of licensed material in use and in storage, there shall be a means to monitor and immediately detect, assess, and respond to unauthorized access RAMQC and devices. Enhanced monitoring shall be provided during periods of source delivery or shipment, where the delivery or shipment exceeds 100 times the Attachment 5.1 values. 4.3.2 There shall be an immediate response to any actual or attempted theft, sabotage, or diversion of radioactive material or the devices containing them. The response shall include requesting assistance from a Local Law Enforcement Agency (LLEA). 4.3.3 There shall be a dependable means to transmit information between and among the various components used to detect and identif)/ an unauthorized intrusion, to inform the GM, RSO, SVPRA, and the PA Manager, and to summon the appropriate responder. 4.3.4 After initiating appropriate response to any actual or attempted theft, sabotage, or diversion of radioactive material or of the devices, notify the NRC Operations Center at (301) 816-5100 within four (4) hours of contacting the LLEA. 4.3.5 Documentation shall be maintained describing each instance of unauthorized access and any necessary corrective actions to prevent future instances of unauthorized access. 4.3.6 For portable devices, have two independent physical controls that form tangible barriers to secure the material from unauthorized removal when the device is not under direct control and constant surveillance by the licensee. 4.3.7 For mobile devices that are only moved outside of the facility (i.e., on a trailer), have two independent physical controls that form tangible barriers to secure the material from unauthorized removal when the device is not under direct control and constant surveillance. For mobile devices that are only moved inside a facility, only one such physical control is required. 4.3.8 For devices in or on a vehicle or trailer, utilize a method to disable the vehicle or trailer when not under direct control and constant surveillance. 4.4 Local Law Enforcement Agency Coordination 4.4.1 The RSO shall coordinate, to the extent practicable, with an LLEA for responding to threats to the facility, including any necessary armed response. The information provided to the LLEA must include a description of the facilities and the category 1 and category 2 quantities of radioactive materials along with a description of the security measures that have been implemented to comply with this subpart; and a notification that the GM or RSO will request a timely armed response by the LLEA to any Non-Proprietary Page 9 of 17 Clive RAMQC CL-SE-PR-030 , Revision 6 actual or attempted theft, sabotage, or diversion of category 1 or category 2 quantities of material. 4.4.2 The GM or RSO shall notify the appropriate NRC regional office within three (3) business days if the LLEA has not responded to the request for coordination within 60 days of the coordination request; or the LLEA notifies the GM or RSO that the LLEA does not plan to participate in coordination activities. 4.4.3 The RSO shall document its efforts to coordinate with the LLEA. The documentation must be kept for three (3) years. 4.4.4 The RSO shall coordinate with the LLEA at least every 12 months, or when changes to the facility design or operation adversely affect the potential vulnerability of the licensee's material to theft, sabotage, or diversion. 4.4.5 A pre-arranged Plan with LLEA shall be maintained for assistance in response to an actual or attempted theft, sabotage, or diversion of radioactive material or of the devices which is consistent in scope and timing with a realistic potential vulnerability of the sources containing such radioactive material. The pre-arranged Plan shall be updated when changes to the facility design or operation affect the potential vulnerability of the sources. 4.4.6 For short term temporary project sites, the LLEA coordination is not required; however, LLEA coordination may be required as directed by the GM and the RSO depending upon the amount of activity being handled, the project location and the potential risks as associated with the project. 4.5 Training 4.5.1 The RSO shall conduct training to ensure those individuals implementing the security program possess and maintain the knowledge, skills, and abilities to carry out their assigned duties and responsibilities effectively. The training must include instruction in the security program and procedures (as cited in Reference 2.5) to secure category 1 or category 2 quantities of radioactive material, and in the purposes and functions of the security measures employed; the responsibility to report promptly to the GM and RSO any condition that causes or may cause a violation of this procedure's requirements; the responsibility to report promptly to the Local Law Enforcement Agency and the GM and RSO any actual or attempted theft, sabotage, or diversion of category 1 or category 2 quantities of radioactive material; and the appropriate response to security alarms. 4.5.2 In determining those individuals who shall be trained on the security program, the RSO shall consider each individual's assigned activities during authorized use and response to potential situations involving actual or attempted theft, diversion, or sabotage of category 1 or category 2 Non-Proprietary Page 10 of 17 Clive RAMQC CL-SE-PR-030 Revision 6 quantities of radioactive material. The extent of the training must be commensurate with the individual's potential involvement in the security of category 1 or category 2 quantities of radioactive material. 4.5.3 Refresher training must be provided at a frequency not to exceed 12 months and when significant changes have been made to the security program. This training must include review of the training requirements this section and any changes made to the security program since the last training; reports on any relevant security issues, problems, and lessons learned; relevant results of NRC / DWMRC inspections; and relevant results of the review and testing and maintenance. 4.5.4 The RSO shall maintain records of the initial and refresher training for three (3) years from the date of the training. The training records must include dates of the training, topics covered, a list of licensee personnel in attendance, and related information. Training shall be provided as needed to the appropriate "trustworthy and reliable" personnel on the site specific controls and security measures as applicable to the performance of their job functions. 4.6 Reporting of Events 4.6.1 The GM or RSO shall immediately notify the LLEA after determining that an unauthorized entry resulted in an actual or attempted theft, sabotage, or diversion of a category 1 or category 2 quantity of radioactive material. As soon as possible after initiating a response, but not at the expense of causing delay or interfering with the LLEA response to the event, the GM or RSO shall notify the NRC's Operations Center (301-816-5100). In no case shall the notification to the NRC be later than four (4) hours after the discovery of any attempted or actual theft, sabotage, or diversion. 4.6.2 The GM or RSO shall assess any suspicious activity related to possible theft, sabotage, or diversion of category 1 or category 2 quantities of radioactive material and notify the LLEA as appropriate. As soon as possible but not later than four (4) hours after notifying the LLEA, the GM or RSO shall notify the NRC's Operations Center (301-816-5100). 4.6.3 The initial telephonic notification required by Section 4.6.1 must be followed within a period of 30 days by a written report submitted to the NRC by an appropriate method listed in § 37.7. The report must include sufficient information for NRC analysis and evaluation, including identification of any necessary corrective actions to prevent future instances. 4.6.4 Upon receipt of notification of a shipment of a category 2 quantity of radioactive material bound for Clive, the S&R Manager or designee shall notify security when a RAMQC shipment is scheduled and confmn its receipt with the originator. If the shipment has not arrived by the no-later- than arrival time, the S&R Manager shall notify the originator.
