This letter is in response to a letter received from the department dated June 4, 2018.
Titled: Nuisance Compliance Issues
First,
• With regard to full occupancy of the Material Recycling Facility, we are very
disappointed that we cannot have the facility running today. The Date of June 15,
2018 was presented back in March as a projection. We have tried to meet this date
but at this point are not complete, given the disruption from the nuisance complaints
and the media attention that followed. Construction has been delayed with efforts
needed to address the requirements issued from the State and the city of Ogden. We
have also had issues with our subcontractors meeting construction deadlines. We
will continue to push for the completion of the facility and have found a
subcontractor that will be here on Monday morning to go over the project and help
us make sure that we can stay on a reasonable schedule. We should see better
progress by end of next week. Given the delay on occupancy we feel it is and will be
our responsibility moving forward to continue with the Mowing options until which
tfine we can control our waste inside of a structure.
Second,
• As we were aware of the letter and that it was forth coming we were proactive
and immediately took action to prevent additional heavily contaminated
cardboard loads coming in from haulers trying to take advantage of our current
pricing and procedures. We notified All Customers via email (May 22, 2018) of
the price increase, Increased our price across the board on general and
construction waste to 42.00 the price increase took affect June 1" 2018 This
measure reduced our incoming waste and allowed us more focus on the loads
and discourage particular haulers from dumping the material that was causing the
issues. We have taken measures given the gravity of the nuisance, to make the
customers more aware of what we can and cannot handle in our yard under the
current conditions.

Third,
• We posted on the scale house and the unattended scale that we no longer will
accept food waste. This happened on the 1" as well.
Fourth,
• We are and will continue to pursue options to minimize the blowing plastics and
paper products, for example tighter bunkers and golf course netting. We have
ordered additional machines for the outside pick-line that will double the amount
of material processed in the same amount of time. This can come online sooner
than the entire system and will help us keep smaller stock piles.
We are very aware of our responsibility to our neighbors and will continue to make
sure we can stay on top of what we are doing in the future. The growth of our family
business is a clear statement for the need of our services in this community. With
growth comes challenges, but know we are committed to upholding the regulation
required to provide this service.
