FACILITY DESCRIPTION:
Recycled Earth LLC (Recycled Earth) has conducted recycling and composting operations at this location for
approximately 10 years. The facility is located in an industrial area of Ogden, near the West Haven City limits. Recycled
Earth's offices are located across the street from the main recycling yard/transfer station. Recycled Earth has an approved
Plan of Operation to operate a transfer station. The facility consists of a large lot, about /z of which is paved, and contains
a scale house in the entrance Lrea, abaling building where recyclables and commodities are baled, and a large, unfinished
material recycling building that is under construction. [n the back of the lot are unloading areas where construction and
demolition (C&D) materials are unloaded for processing in the C&D pick line. Single stream recyclables are currently
being unloaded and sorted through the same pick line - the single stream recyclables will be moved indoors to the
material recycling building as soon as that building is completed.
CRBDENTIALS, PURPOSE AND SCOPE:
Patrick Sheehan met with and presented credentials to David Rawson in the facility offices. The purpose of the inspection
was to follow up on complaints received recently by both the Division and the local health department regarding nuisance
gulls at the facility. After a discussion of operations and the status of the facility and complaints, Patrick Sheehan and
David Rawson walked through the main facility operations and observed operations. Nicole P-Turner joined the
inspection after the walk-through of the facility.
MANAGEMENT ACTIVITIES AND OBSBRVATIONS:
Currently, Recycled Earth's material recycling building is still undergoing construction, and therefore, all C&D and single
stream recyclables are being sorted through the C&D pick line. The C&D pick line is located on the south side of the
property and west of the Material Recycling building. The unloading and temporary storage of C&D and recyclable
materials is being done outside in the main lot. This material is fed into the pick line, where it is sorted and segregated
depending on the material. The materials that are not sorted in the pick line are then loaded into trucks for landfill
disposal. Segregated materials are baled, stored adjacent to the Material Recycling building, and sent off to 3'd parties for
further recovery.
The gull nuisance has partially retumed to the facility. In early April, the Division had received complaints about a gull
nuisance, which was confirmed during an April 5, 2018 inspection. On April 5fr, hundreds of gulls were observed at the
facility, and many gulls had congregated onto building tops and on the ground. The facility had begun to utilize bird
alarms and screamers to mitigate the issue, and during the April 12,2018 inspection, the gull nuisance had been abated.
However, during this inspection of May 16,2018, approximately 75 - 100 or more gulls had returned and were creating a
nuisance, albeit on a much smaller scale than what was observed on April 5'h'in which several hundreds of birds were
causing a nuisance.
Based on the facility's submitted Plan of Operation application and drawings, David Rawson's responses to questions,
and a walk-through of the site, the following observations were made:
r Enough gulls have returned to the facility to create a nuisance. It appears that the gulls are now attracted to the
commercial C&D storage area on southwest side of facility, just west of the C&D pick line. It appears that some
trash in the C&D waste stream had been received that is creatins the attraction for the birds.
r The facility is still utilizing screamers and bird alarms, and has also been using a shrill gun (periodically) to
disperse the birds. During the inspection, an employee used the shrill gun, and all of the birds dispersed into the
sky for approximately l0-15 minutes before some began to return. David Rawson stated that the employees are
supposed to fire the shrill gun periodically as needed to keep the birds from congregating on the ground and on
the material piles.
o The facility receives unrecyclable waste as part of its commercial C&D materials. This unrecyclable waste is sent
for disposal at several landfills, including Wasatch Regional in Tooele County, Intermountain Regional Landfill
in Utah County, and the Tekoi Landfill in Tooele County. Mr. Rawson stated that at the end of each day,
Recycled Earth trucks return to the facility and are loaded with unrecyclable waste, and that these trucks transport
that waste to landfills early the next dav.
o Mr. Rawson stated that the facility is currently transporting approximately 3,500 tons of waste to landfills per
month. This waste consists of commercial account recyclable materials that are unrecyclable, as well as general
garbage from some commercial accounts.
The single stream recyclables are being received from Davis and Weber counties, and due to market conditions,
the facility has received and processed increasing amounts recently. Currently, approximately 1000 tons per
month is being processed on site, according to Mr. Rawson during a previous inspection;
Single stream sorting and separation is currently being conducted on the C&D pick line, as the Material Recycling
building is not yet complete. When this building is approved for occupation, the single stream sorting will be
moved to this building.
The concrete floor has been poured inside the MRF building; however the floor is still curing. Mr. Rawson stated
that the floor will not be ready for loads until the drywall and electrical have been completed. He believes that the
building will have occupancy approval by approximately June 15, 2018.
Upon receiving occupancy approval for the MRF building, Mr. Rawson stated that he would begin to move the
single stream recyclable materials to inside the building, where they will be stored and processed.
SUMMARY:
The facility has a bird nuisance issue which is causing problems for neighbors and businesses. The inspection revealed
that the C&D waste storage material on the southwest area of the facility are attracting the birds, as some unrecyclable
waste and garbage is received and stored at this location. The inspectors discussed various items that would help to
alleviate the nuisance, including moving the single stream storage and sorting operations indoors into the Material
Recycling building. Also, David Rawson stated that he would also attempt to move the C&D material piles inside the
MRF building as well, as a way to mitigate any nuisances. The inspectors also recommended tighter inspection of
received materials to minimize unrecyclable wastes and garbage received.
Mr. Rawson stated that he anticipates moving the single stream receiving, storage, and recycling activities inside the
building by June 15, 2018. This will mitigate some of the nuisance issues. He stated that he would consider moving the
C&D materials inside the building as well as a mitigation measure. In addition, he stated that he would be rejecting loads
that may contribute to the nuisance problem.
