Box 218 Grants, NM 87020 RE:Closeout of Compliance Advisory No. 2404069 (DRC-2024-005306) Radioactive Materials License UT 1900481 Dear Ms. Ruedig: On April 8, 2024, the Division of Waste Management and Radiation Control (the Division) received a letter dated March 7, 2024 from Rio Algom Mining LLC (RAML) (DRC-2024-005208). The letter notified the Division of a potential gap in RAML’s compliance with condition 12 of its license, Radioactive Material License NumberUT 1900481 (the License). In response, the Division issued Compliance Advisory No. 2404069 on April 26, 2024 (DRC-2024-005306)that identified corrective actions necessary to restore compliance.A review of your corrective actions submitted on May 14, 2024 (DRC-2024-005640)has supported the Division’sdetermination that your facility is now in compliance with the license conditions. In the compliance advisory, the Division requested that RAML re-visit and confirm that sites 42SA20949 and 42SA31316 were avoided and notdisturbed during site activities. In its response, RAML indicated it will re-visit the sites while conducting cultural heritage surveys of its property not previously surveyed. RAML indicated it will confirm the status of these sites to DWMRC in the associated cover letter and report to DWMRC. Please be advised that, per Utah Code Section 63G-2-305(26), “records that reveal the location of historic, prehistoric, paleontological, or biological resources that if known would jeopardize the security of those resources or of valuable historic, scientific, educational, or cultural information” are protected records. When submitting cultural heritage surveys to the State of Utah, please send any record that may be subject to Utah Code Section 63G-2-305(26) to the Utah State Historic Preservation Office and not the Division. Please indicate the required compliance status in a separate letter submitted to the Division. Upon receipt, should the Division have further questions regarding the details of the protected records, the Division will coordinate with the State Historic Preservation Office.
