Re: Annual Report for the Tony M Mine Under Code of Federal Regulations (CFR) 40Part 61,
Subpart B - National Emissions Standards for Hazardous Air Pollutants.
Dear Sir or Madam:
The provisions of 40 CFR 61, Subpart B - National Emissions Standards for Hazardous Air Pollutants, are
applicable to the owner or operator of an active underground uranium mine. As used in 40 CFR Subpart
B, Part 61.21 active means o'an underground uranium mine which has been ventilated to allow workers to
enter the mine for any purpose."
During the required reporting period of calendar,year 2023, the Tony M Mine (the "Mine") was inactive as
described in the above definition provided in 40 CFR 61.21. The Mine was placed on standby, due to the
low price of uranium on the spot market, in February 2013, and in calendar year 2023, the ventilation
systems were not operated for any purpose. Mining is expected to recommence when market conditions are
more favorable. In the meantime, the mine facilities will be maintained in good condition to allow for a
smooth restart of mine operations.
On October 27,2027, Energy Fuels Resources (USA) Inc. ("EFRI") transferred ownership of the Tony M
Mine to Consolidated Uranium Inc. ("CUR," flWa International Consolidated Uranium Inc.), which
thereafter transferred the asset into its newly formed U.S. subsidiary CUR Henry Mountains Uranium, LLC
(a Utah Limited Liability Company having offices at 217 Queen Street West, Floor 4, Toronto, Ontario
M5V 0R2, Canada). EFRI, which continues to act as the operator of the mine pursuant to an Operating
Agreement between the parties, is submitting the attached annual report on CUR's behalf.
Pursuant to the definition in 40 CFR Part 61, Subpart B, the annual reporting requirements are applicable
to active underground uranium mines. Therefore, the annual reporting requirements as specified in 40 CFR,
Part, 6l .24 are not applicable to the Mine for the calendar year 2023.
This letter serves as the notification that an annual report for the Mine will not be submitted for calendar
year 2023, because the ventilation systems were not operated during 2023.
