Dear Mr. Wells:
On April 29, 2024, a Notice of Violation and Compliance Order (NOV/CO) was issued to you by the Division of Waste Management and Radiation Control (Division) in which you were ordered
to correct the violationof not abiding by the waste handling procedures of Utah Admin. Code R315-302-2(2)(b). You were required totaking the following actions:
Immediately cease the acceptance of all solid waste, including waste in liquid form, until Quick Sumpnotifies the Director in writing that construction of the Transfer Station is complete
and a Divisioninspection confirms the Transfer Station construction is finalized.
a. Upon a Division inspection verifying the Transfer Station construction is finalized and theTransfer Station is operational, the Director may issue a letter approving Quick Sump’sacceptance
of waste at the Transfer Station. Quick Sump shall not accept waste until it receivesthe Director’s approval letter.
Within 30 days of the signature date of this NOV/CO:
Remove the waste from the unapproved outdoor pit and transport the waste to a waste facilitythat is permitted to accept the waste for transfer, treatment, or disposal; and
Submit to the Director:
Waste receipt records from the permitted transfer, treatment, or disposal facility that detailthe amount of waste in tons, and the name and location of the facilitywhere the waste fromthe
unapproved outdoor pit was taken;
A letter detailing the cleanup and deconstruction of the unapproved outdoor pit; and
Deconstruction of the unapproved outdoor pit shall include but is not limited to:
Removal of the installed liner system; and
Filling the pit with uncontaminated soil to be at the same grade as thesurrounding ground level.
Photos that support the cleanup and deconstruction of the unapproved pit.
On May 06, 2024, the Division received your response to the NOV/CO (DSHW-2024-006160). In response to this submission, a Division representative conducted an inspection of the Quick
Sump Service, Inc. transfer station on May, 09, 2024 (DSHW-2024-xxxxxx). The inspection confirmed the information submitted in your response that the building was complete and appeared
operational, and that the unapproved waste pit looked to be fully deconstructed as required by the NOV/CO.
As of the date signed on this letter, Quick Sump Service, Inc. may begin operating in accordance with the approved Plan of Operation (DSHW-2021-017044) under the following conditions:
The facility shall be operated in accordance with the Plan of Operation submitted by
Quick Sump Service, Inc. received October 6, 2021. In addition, the facility shall be
operated in compliance with R315-313-2 and R315-302-2 of the Utah Administrative
Code. Any changes to operations at the facility or the Plan of Operation must be
approved prior to implementation.
This approval does not provide any exemption from complying with other required local,
state, and federal agency approvals.
The facility shall accept only nonhazardous waste.
Petroleum-contaminated soils as defined by R315-315-8 of the Utah Administrative Code
may be disposed in an applicable permitted landfill after the drying process is completed.
Daily operating records of all solid waste acceptance and transfer shall be kept at the
facility. An annual report shall be submitted to the Division by March 1 of each year.
