Dear Mr. Larson:
The Division of Environmental Response and Remediation (DERR) received your
Groundwater Monitoring Report, on December 22, 2023. The DERR has reviewed the report and
determined that residual soil and groundwater contamination at your Release Site must be addressed.
As outlined in Utah Admin. Code R311-202, Sections 280.66 and 280.67, a Corrective Action
Plan (CAP) to address the contamination at your site needs to be completed and submitted within 120
days of receipt of this letter. Cleanup levels for your site will be established using the criteria and
standards required by Utah Admin. Code R311-211, and as described in the CAP Guide. The DERR
will review the CAP for approval based upon an evaluation of the cleanup plans for the protection of
human health and the environment, cost effectiveness, and use of appropriate cleanup technology.
Alternate corrective action options for this site could include CAP/monitored natural attenuation, a
Tier 2 risk assessment, institutional controls/environmental covenant, etc., in addition to any active
physical or chemical systems to clean up the residual petroleum contamination. The goal is to have
this release on a path to closure vs. continued/indefinite monitoring of groundwater.
The CAP Guide will provide a format for submitting a CAP. The CAP Guide (June 14, 2017)
can be found on our website: https://deq.utah.gov/environmental-response-and-remediation/guidance-
documents-references-lust-program. Any abatement or cleanup activities at your leaking aboveground
storage tank site must be performed by a Utah Certified Petroleum Storage Tank Consultant as outlined
by Utah Admin. Code R311-201-2(1).
