Re: Corrective Action Plan Requirements

Dear Mr. Denison:
The Division of Environmental Response and Remediation (DERR) has re-opened the
Release Site above, at your request. The DERR understands that Gardner Company plans to locate
and remove any residual soil contamination at this Release Site, prior to redevelopment.
As outlined in Utah Admin. Code R311-202, Sections 280.66 and 280.67, a Corrective
Action Plan (CAP) to clean up the contamination at this site needs to be prepared and submitted
within 120 days of receipt of this letter. Cleanup levels for your site will be established using the
criteria and standards required by Utah Admin. Code R311-211, and as described in the CAP Guide.
The DERR will review the CAP for approval based upon an evaluation of the cleanup plans for the
protection of human health and the environment, cost effectiveness, and use of appropriate cleanup
technology.
The CAP Guide will provide a format for submitting a CAP. The CAP Guide (June 14,
2017) can be found on our website: https://documents.deq.utah.gov/environmental-response-and-

015473.pdf. Any abatement or cleanup activities at your leaking petroleum storage tank site must
be performed by a Utah Certified Petroleum Storage Tank Consultant as outlined by Utah Admin.
Code R311-201-2(1).
Please contact your project manager within 30 days to arrange a meeting to discuss cleanup
alternatives and the CAP requirements.
