Box 144880 Salt Lake City UT 84114-4880 Dear Mr. Speer: In reply to your letter of May, 8, 2024, We will answer your questions then ask some question that we have. Burkes Utah Land and Livestock LLC is owned by Jason Godfrey and his father. After the death of his father Jason is the owner of Burkes Utah Land and Livestock LLC. Jason and his wife own Bravo Land Company LLC. It is our understanding that Cache County Parcel Number 15-002- 0001 was included in Bravo Land Company’s permit application. Bravo Land Company LLC’s operator Innovative Food Specialists contracted with Dairy Way Transport LLC to haul and apply wash water and other permitted waste. The pictures of the ruts is from the spring of 2023. They occurred when a truck pulled into the field to unload and sunk in the soft soil before they could get to the unloading area. Kelly Shaw saw these ruts on her annual site visit and was told how they were made and when they would be repaired. They were repaired shortly after her site visit when the ground dried out sufficient to hold the equipment up. The departments letter did not include the date of the alleged infractions nor who reported the alleged infractions. From where the ruts were, there is no way the any liquid waste would get into Stink Creek. From the site of the ruts the water flows South not North. The trailer in the pictures we received May, 14, 2024 has not been in Utah since September 2023. The pictures of the materials on the ground have no reference point to know where they were taken. There are no pictures of the waste water entering Stink Creek. It is our position that no infraction or unacceptable dumping occurred.
