In June 2017 your consultant, Wasatch Environmental, Inc. was preparing to install wells and submit a Correction Action Plan (CAP) for the completion of a remediation system to address the release. To date, no well installation report or CAP has been received by the DERR. As outlined in Utah Admin. Code R311-202, Sections 280.66 and 280.67, a Corrective Action Plan (CAP) to clean up the contamination at your site needs to be completed and submitted within 120 days of receipt of this letter. Cleanup levels for your site will be established using the criteria and standards required by Utah Admin. Code R311-211, and as described in the CAP Guide. The DERR will review the CAP for approval based upon an evaluation of the cleanup plans for the protection of human health and the environment, cost effectiveness, and use of appropriate cleanup technology. If additional wells need to be installed for the purpose of the CAP or for final delineation of the release, they should be installed and a report submitted prior to the CAP submittal. The CAP Guide will provide a format for submitting a CAP. Any abatement or cleanup activities at your leaking petroleum storage tank site must be performed by a Utah Certified PST Consultant as outlined by Utah Admin. Code R311-201-2(1).
