Dear Ms. Weinel:

The Division of Waste Management and Radiation Control (Division) has completed its review of the
4th Quarter 2023 Nitrate Monitoring Report (Report) dated February 12, 2024 (DRC-2024-004530).

The review was based on compliance with the following:

1. Energy Fuels Resources (USA) Inc. Quality Assurance Plan (QAP), Revision 7.7,
dated February 15, 2019.
2. Ground Water Quality Discharge Permit Number UGW370004 (Permit).
3. White Mesa Uranium Mill Groundwater Corrective Action Plan (GCAP) Revision 0,
dated September 14, 2015.

The Division review concluded that the Report appeared to be in compliance with the QAP, Permit, and
GCAP. This letter constitutes a closeout of the Report.
