Ashley Sumner (EDO), Kaci McNeill (WMRC), Tom Ball (WMRC), and LeAnn Johnson (DHRM) Paper copies to: Facility File, Public Participation File, Alisa WestenskowSTATE OF UTAH EMERGENCY PERMIT UT-016-2024Permittee:Hill Air Force BaseUT0571724350Davis County, Utah Pursuant to the Utah Solid and Hazardous Waste Act, Utah Code §19-6-101, et. seq., as amended, and the Utah Administrative Code (UAC R315-260 through R315-270 and R315-124), the Director of the Division ofWaste Management and Radiation Control (Director), based on representations by Hill Air Force Base Explosive Ordnance Disposal (hereafter called the “Permittee”), found the described circumstances potentially posed an imminent and substantial endangerment to human health or the environment and, therefore, issued an oral temporary emergency permit and is now followed by this emergency permit (Permit), to treat a 25 MM projectile round at the Salt Lake City Police Department Disposal/Training Area. The round was confiscated by the Transportation Security Administration at the Salt Lake City International Airport.The Director’s issuance of such Permit is also authorized under Section 3006(b) of the Resource Conservation and Recovery Act (42 U.S.C. § 6926(b).The Permittee shall comply with all terms and conditions of this Permit. ThisPermit consists of the applicable portions of UAC R315-260 through 263,R315-124, and R315-101. Additionally, to the extent possible and not inconsistent with the imminent and substantial endangerment, this Permit also incorporates, applicable requirements of UAC R315-270, R315-264, and R315-266. Applicable rules are those that are in effect on the date of issuance of this permit. The Director’s decision to issue an oral emergency permit, followed by this temporary emergency permit, is wholly dependent upon the premise that the information in a letter received on May 20, 2024 (DSHW-2024-006414) is accurate and the treatment will be conducted as specified in this letter. Any inaccuracies or misrepresentations found in the request described above may be grounds for termination of this Permit, in accordance with UAC R315-270-61(b)(4), and possible enforcement action. The Permittee shall immediately inform the Director of any deviation from, or changes in, the information in the request which would affect the Permittee's ability to comply with the applicable regulations.This Permit is effective May 20, 2024, and expires May 20, 2024, unless terminated in accordance with applicable rules.Signature:Date: _________________Douglas J.
