Dear Andy Garland: On April 11, 2024, the Division of Drinking Water (the Division) received your request for an exception to rules R309-550-11(3), R309-540-5(4)(c), and R309-105-9(3) regarding individual home booster pumps,for Lot 146B in the Colony Subdivision. On May 14, 2024, the Division received your request for a renewal of the exception to rules R309-550-11(3), R309-540-5(4)(c), and R309-105-9(3) that was granted on January 18, 2022, for Lot 146A which is located next to Lot 146B and shares similar design. According to these rules, individual home booster pumps shall not be allowed for individual service from the public water supply mains. Project Background The original exception to rules R309-550-11(3), R309-540-5(4)(c), and R309-105-9(3) for Lots 146A and 146B in the Colony Subdivision was originally requested in August 2018. The project was placed on hold in October 2018. The project was reopened, and an exception was granted on January 18, 2022, for only Lot 146A. At this time, Mountain Regional is requesting the exception to Lot 146B. These are the only two lots which will require individual home booster pumps, Mountain Regional Water SSD does not anticipate any other similar facilities needing exceptions in the future. Lot 146A is still unconstructed at the time of this letter. However, the exception is due for a renewal at the end of this year. The renewal is also included in this letter. The original exception details are included in the later Dated January 18, 2022. Both lots share a similar design for the home booster pump. Except for the Lot 146A is located in a room attached to the main building and Lot 146B is located in a separate building. Further, Lot 146A has two 5,000-gallon tanks where Lot 146B has one 5,000-gallon tank. The properties are located within Mountain Regional Water SSD’s service area and pressure zone. However, after hydraulic analysis, it was found that the minimum pressures required per rule R309-105-9(2) cannot be met due to the lots’ high elevation. Fire protection can be provided by a fire hydrant and is approved by the Park City Fire District. Exception Request The basis for your request for an exception to R309-550-11(3), R309-540-5(4)(c), and R309-105-9(3)) for Lot 146B is that due to the elevation of the property the required minimum pressures cannot be met and will need to install an individual home booster pump. The individual home booster pump will be installed with the following protections: The residential water service and meter will be connected to the Mountain Regional Water SSD water system. Mountain Regional Water SSD takes the responsibility of the water quality to the water meter. Downstream of the water meter, water quality will be the responsibility of the property owner. The interim tank and individual home booster pumps are to be housed in a separate heated building that is below grade and not attached to the residential structure. To ensure no flooding of the building, the area surrounding the residence will be graded to drain away from the structure. In addition, the pump room will be installed with a floor drain larger than the overflow of the interim tank that drains to daylight. The tank and all appurtenances will comply with NSF/ANSI 61. An 18-inch air break will be provided between the 2-inch diameter tank inlet pipe and 3-inch diameter overflow pipe of the interim tank. The interim tank will have a screened overflow that has #4 and #24 stainless steel screens on the discharge end, drains to the atmosphere, and has 12 inches of clearance above grade. The individual home booster pump and interim tank installation and the required backflow prevention assembly will be included in the Mountain Regional Water SSD’s cross connection control inventory. An approved backflow prevention double check assembly (Wilkins DC 350 or equal) will be installed downstream of the water meter prior to the tank inlet and tested according to the Mountain Regional Water SSD’s cross connection control plan. The homeowner will be responsible for testing. Mountain Regional Water SSD proposes the following measures the water system will take to provide equivalent protection for public health to meet the intent of the rule: The individual home booster pump for Lot 146B will be added to Mountain Regional Water SSD’s cross connection control (CCC) program. Provisions are in place for Mountain Regional Water SSD’s staff to inspect the entire facility as part of the ongoing enforcement included in the CCC program with a separate entrance for staff. If there are any issues with a CCC onsite, it is within Mountain Regional Water’s SSD rules and regulations to suspend service to the property. This can be done at the meter pit and not within the individual home booster pump building. As part of the design, there is an 18-inch air break provided between the 2-inch diameter water service lateral and the 3-inch diameter overflow of the interim tank. Further, a 4-inch diameter drain to daylight ensures the building will not flood if the tank is overflowing. Additionally, there is also an inline, testable, double-check valve located on the water service lateral prior to the air break. On this basis, exceptions R309-550-11(3), R309-540-5(4)(c), and R309-105-9(3), Individual Home Booster Pumps, is hereby granted for Lot 146B and a renewal is granted for 146A for the Colony Subdivision. These Temporary Exceptions expire onDecember 31, 2027. After the lots are constructed, you must submit the annual test records showing the backflow assemblies were tested according to Mountain Regional’s cross connection control program. If the lots are still undeveloped, please submit for a renewal with a statement that the booster pumps are not in service yet. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal prior to December 31, 2027. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. Failure to request the re-evaluation of this exception and obtain an exception renewal by December 31, 2027, will result in the activation of the deficiency related to not having connections rely on individual booster pumps due to inadequate system pressure. These Temporary Exceptions may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception. Please maintain a copy of this letter with your permanent records for future reference.
