Gentlemen – Salt Lake County Ordinance 9.96.070 B. requires the following:

Solid waste generated outside of Salt Lake County, but from within the State of Utah shall not be accepted at any
publicly owned solid waste management facility located within the geographical limits of Salt Lake County without
prior authorization of the Utah Department of Environmental Quality, and the Salt Lake County Health
Department.

This email requests your approval to accept approximately 100 Tons per month of “Residential Curbside MSW” from the
Lakepoint Neighborhood of Tooele County. This material will be hauled by Ace Disposal.

Hi Brian,
SLVSMWC is looking to accept 100 tons of Tooele's curbside MSW per month moving forward, but need permission from
DEQ as per Salt Lake County Ordinance. The request seems reasonable to me. Can I tell them yes? Or do they need
approval from you and/or Doug?

Hi Patrick,
The acceptance of the waste would only be an issue if you were receiving the waste for profit. If you were to
receive payment (beyond typical fees) for the waste, SLVSWMF MSW would become a commercial facility and no longer
be a Class I Landfill.
If you could send us some sort of proof that the waste will not be accepted for-profit (ie. a contract with Tooele/Lakepoint
or an affidavit stating that it would not be accepted for-profit) then we should be good to go.

R315-301. Solid Waste Authority, Definitions, and General Requirements.
R315-301-2. Definitions.
(7) "Class I Landfill" means a non-commercial landfill or a landfill that meets the definition found in Subsection 19-6-102(3)
(a)(iii) and is permitted by the Director
(a) to receive for disposal:
(i) municipal solid waste;
(ii) any other nonhazardous solid waste, not otherwise limited by rule or solid waste permit; or
(iii) in conjunction with municipal solid waste or other nonhazardous solid waste, waste from a very small quantity
generator of hazardous waste, as defined by Section R315-260-10; and
(b) does not meet the standards of Subsection R315-303-3(3)(e)(v).

Section 102, Definitions.
...
(3)(a) "Commercial nonhazardous solid waste treatment, storage, or disposal facility" means a facility that receives, for
profit, nonhazardous solid waste for treatment, storage, or disposal.
(b) "Commercial nonhazardous solid waste treatment, storage, or disposal facility" does not include a commercial facility
that:
(i) receives waste for recycling;
(ii) receives waste to be used as fuel, in compliance with federal and state requirements;
(iii) is solely under contract with a local government within the state to dispose of nonhazardous solid waste generated
within the boundaries of the local government;
