Dear Ms. Weinel: The Division of Waste Management and Radiation Control (Division) received your claim of business confidentiality related to the application and supporting documents for a Research and Development
License under Utah Administrative Code R313-70-7(k) submitted to the Division. Upon review of the
documents, the Division determined that the claim of business confidentiality made by Energy Fuels Resources (USA) Inc. (EFRI) meets the requirements of Utah Code Section 63G-2-309. As a result, the Division will manage the applicable information in the records in accordance with Utah Code 63G-2-305. Future consideration of record disclosure is also subject to Utah Code Section 63G-2-309(1)(b)
and (2).
NOTICE OF APPEAL RIGHTS This letter involves an agency action. If you disagree with the agency determination described above,
you may appeal the agency determination within 30 days of the date of this letter by filing a notice of
