Dear Kent L. Peterson:
The Division of Drinking Water (the Division) has not received updated Drinking Water Source Protection (DWSP) plans for the Oak Creek Spring or Well #1, which were required by December
31, 2011, and December 31, 2010, respectively. Deficiencies (SP04 ACTIVE SOURCE LACKS APPROVED UPDATES TO DWSP) were previously added to the Division’s database and ten (10) Improvement
Priority System (IPS) points assigned, five (5) points per source. Guidance for preparing updated DWSP plans can be found online at https://deq.utah.gov/drinking-water/preparing-source-protection-plans.
The Oak Creek Spring formerly had a monitoring reduction use waiver for pesticides but the Oak Creek Spring is no longer eligible because the requirements of R309-600-13(3) have not
been met. In general, the presence of residences in source protection zones one, two or three implies that pesticides are used, and a use waiver in those cases cannot be granted. At
least one residence appears to exist within source protection zone two.
In accordance with the requirements given in R309-205, Marion Waterworks Co. is now required to sample the Oak Creek Spring (WS001) for the contaminants listed in the table below at
the outlined frequencies by the given due dates.

These changes are reflected in the enclosed monitoring schedule and can be viewed anytime online at waterlink.utah.gov.
As a community water system serving less than 3,300 persons, Marion Waterworks Co. qualifies for reduced pesticide monitoring. Please submit a pesticide sample from the Oak Creek Spring
sometime between July 1, 2024, and September 30, 2024. If the results show no detections, the pesticide schedule can be reduced from one sample per quarter to one sample every three
years.

Protection RemindersAs stated in R309-600 and 605: Implementing DWSP Plans - Each Public Water System (PWS) shall begin implementing each of its DWSP Plans in accordance with the implementation
schedule within 180 days after submission if the plan is not disapproved. Be prepared to describe these efforts in your next update, which should include documentation of how the land
management strategies identified for existing and future potential contamination sources were implemented. Your updated plan will be disapproved, and 25 Improvement Priority System (IPS)
points will be assigned for failure to comply with this requirement.As stated in R309-600 and 605: Recordkeeping - As a DWSP Plan is executed, the PWS shall document any land management
strategies that are implemented. Please provide actual copies of memoranda of understanding, public education programs, bill stuffers, newsletters, or other correspondence documenting
