Well (Aka 4), and Lower Cold Water Spring; North Ogden City; Water System #29010, Source No. WS001, WS002, WS003, WS004, WS005, WS006, WS007, and WS008.
Dear David Paul Espinoza:
The Division of Drinking Water (the Division) received the updated Drinking Water Source Protection (DWSP) plan for Well 1, Well 2, Well 3, and Lakeview Heights Well (Aka 4) from your
consultant, Mark Chandler, P.E., with CRS Engineers, on March 28, 2023. The Division received the updated DWSP plans for the Upper Cold Water Spring, Rice Creek Spring, North Ogden Canyon
Spring, and Lower Cold Water Spring from your consultant Emily Thomas, with Jones & Associates Engineers, on December 7, 2023.
We have completed our review of the updated DWSP plans and find that the plans basically comply with the applicable portions of Utah’s Administrative Rules for Public Drinking Water
Systems. The Division concurs with these updated plans. We commend you for establishing a program to protect these sources from present and future contamination. These plans must be
updated often enough to ensure that they reflect current conditions in your protection zones.
The due date for submitting the next updated plan for the wells is December 31, 2026.
The due date for submitting the next updated plan for the sptings is December 31, 2029.
Note
The date that management strategies were implemented, such as public education, should be specified in the implementation section or on the recordkeeping document. Only stating that
material is distributed annually is not sufficient. This date helps to indicate that the PWS has implemented their public education at least once in the last update cycle (six years).
If no date is
specified, the Division cannot tell if the system is actually distributing public education material. This information was not provided for WS003, WS004, WS005, or WS007. Please include
this information in the next update to avoid disapproval.
Monitoring Reduction Waivers
The Upper and Lower Cold Water Springs were previously approved for use waivers. Division rules require that PWSs submit a signed waiver with each updated plan to keep the current waiver
active. If the PWS would like to keep their use waiver active, submit a signed use waiver form within 90 days of the date of this letter. RemindersAs stated in R309-600 and 605: Implementing
DWSP Plans - Each Public Water System (PWS) shall begin implementing each of its DWSP Plans in accordance with the implementation schedule within 180 days after submittal if the plan
is not disapproved. Be prepared to describe these efforts in your next update, which should include documentation of how the land management strategies identified for existing and future
potential contamination sources were implemented. Your updated plan will be disapproved, and 25 Improvement Priority System (IPS) points will be assigned for failure to comply with this
requirement.As stated in R309-600 and 605: Recordkeeping - As a DWSP Plan is executed, the PWS shall document any land management strategies that are implemented. Please provide actual
copies of memoranda of understanding, public education programs, bill stuffers, newsletters, or other correspondence documenting the implementation of each land management strategy as
