The release was reported to the DERR based on an anonymous caller spill notification to the National Response Center. Below is a summary of the current status of the suspected release: Contact Information for Responsible Party (RP) Name: Don Reusch Telephone Number: (435) 673-4889 The extent and degree of contamination has not yet been determined, and it remains unknown as to whether any additional sampling, investigation, or corrective action has been undertaken at the site. Potential immediate threats are not known to exist. On April 19, 2023 a DERR employee spoke to a crane operator at a tank install who is familiar with the site. This individual claimed that the 500- gallon AST which is believed to be the source of the release is no longer in use and the AST piping is aboveground. None of the ASTs at this site sit on soil or gravel. LC    Page 2 Based on this information, the DERR does not have authority to regulate this release as Utah’s Underground Storage Tank Act does not regulate releases of petroleum hydrocarbons from ASTs that do not have contact with the ground and/or ASTs that do not have underground piping. The RP has refused to allow Department of Environmental Quality representatives access to the property. Due to the lack of cooperation from the RP, the DERR was not able to get an oversight agreement signed. Therefore, I recommend that the case file (copy attached) be transferred to the Division of Water Quality for oversight, and that an electronic copy of the release information be filed in the closed LUST files. DERR will not send a No Further Action Letter for this release. BHE/LC/rr
