Hi Travis,
I'm reviewing the DWSP plan for Torrey Town's Hells Hole Spring and West Sulphur Creek Spring. Before I can concur can you please address the following:
1. In the attached PER concurrence letter, an exception to R309-600-13(2)(d) - Land Use Agreements, Letters of Intent or Zoning Ordinances was granted for these water sources on several conditions. Two of these conditions
were (1) a locked fence would be installed around the spring area and (2) diversion channels would be installed on the high side of the springs to divert any overland drainage that could contaminate the spring collection area.
Although the plan describes the fence as having been installed, there is no mention that the diversion channels were constructed. Please specify whether this condition has or has not been met. For this plan to be concurred
with, these conditions need to be completed. Otherwise, a signed LUA from the US Forest Service needs to be provided.
2. A use waiver was submitted to reduce the monitoring frequency of these sources. I will be able to approve the waiver for contaminants in the VOC parameter group. However, to be approved for pesticides, a signed statement
must be provided by the US Forest Service confirming that no pesticides have been used along the dirt roads in the management areas. This is not required for me to concur with the DWSP plan, just for the approval of
monitoring reduction for pesticides.
Please address the above issues and share the revised plan in this email. Let me know if there are any questions.

Thank you for the comments on the Torrey Town DWSP, I just have a few updates and a question.
We are currently in the process of getting the Forest Service Use Waiver for Pesticides signed.
The diversion channels were installed on the high side of the springs to divert any overland drainage that could contaminate the spring collection area.
I have updated Section 4 (for both PCS Dirt road and animal grazing) of the DWSP to include the language "The diversion channels were installed on the high side of the springs to divert any overland drainage that could contaminate the
spring collection area."'
Do I need to include this language in any other section of the DWSP?

I'd suggest adding this language to section 3.2 as well since fencing is also discussed here. Just for thoroughness. That should be sufficient for the division's approval of the plan.

Technically this document is the use waiver application which was already submitted. We just need a general statement about pesticide use, such as the following:
"I, (name/title) of the United States Forest Service (USFS), hereby state that pesticides are not being used and will not be used within the management areas of West Sulphur Spring (WS005) and Hells Hole Spring (WS008)"
