Dear Logan Moffett: On January 22, 2024, the Division of Drinking Water (the Division) received your request for an exception to R309-515-6(6)(i), Well Sealing Techniques and Requirements regarding MHP Well 1 (WS001). According to this rule, all public drinking water wells shall have the annulus between the outermost well casing and the borehole sealed with grout to a depth of at least 100 feet below the ground surface unless an “exception” is issued by the Director. Background It is our understanding that the MHP Well 1 (identified as WS001 in the Division’s database) was completed around July 17, 1973, based on the enclosed Report of Well Driller. This report indicates that a surface seal was not completed. The well was used for domestic purposes by a non-public water system. The Wasatch Mobile Home Park has grown and now meets the definition of a public water system (PWS) and is classified as a Community Water System. Therefore, the MHP Well 1 (WS001) is required to meet the Division’s construction standards outlined in R309-500. As part of these requirements, the MHP Well 1 (WS001) must be sealed according to R309-515-6(6)(i), Well Sealing Techniques and Requirements to obtain an Operating Permit. Logan Moffett February 26, 2024 Page 2 of 4 Exception Request The basis for your request for an exception to Rule R309-515-6(6)(i), Well Sealing Techniques and Requirements, is that the well was drilled before this was a requirement. As a result, the Wasatch Mobile Home Park has conducted water quality monitoring as part of becoming a community water system. The water quality monitoring started in 2020 according to the following monitoring schedule. The results of this monitoring show detections above the minimum detection limit for certain chemicals but below the maximum contaminant level (MCL). The detected chemicals include barium, selenium, sulfate, TDS, turbidity, cyanide, fluoride, radiologic chemicals, and nitrate. Based on these results, the WHP Well 1 (WS001) meets the requirements for initial source sampling for new drinking water sources for public water systems and has been compliant with the above monitoring schedule. On this basis, an exception to R309-515-6(6)(i), Well Sealing Techniques and Requirements, is hereby granted for WHP Well 1 (WS001). 1. This Temporary Exception expires on February 23, 2026. 2. This water system is required to comply with the following source water monitoring for the MHP Well 1 (WS001) at sampling locations that are prior to treatment: a. Take monthly source bacteriological samples for the months this source is accessible. i. The source sampling requirement shall begin once a Temporary Operating Permit has been issued for this well and extend to cover the duration that the well is in operation. ii. The sampling location of the source water bacteriological samples needs to be labeled as WS001. Logan Moffett February 26, 2024 Page 3 of 4 iii. The source bacteriological sampling is in addition to the monthly total coliform sampling in the distribution system (DS001) that has been in place for your water system. iv. In case of any positive bacteriological sample result, contact Sitara Federico at (385) 515-1459 or sfederico@utah.gov within 24 hours of notification from the laboratory. b. Take quarterly nitrate samples. i. The source sampling requirement shall begin once a temporary operating permit has been issued and extend to cover the duration that the well is in operation. ii. The sampling location of the source water nitrate samples needs to be labeled as WS001. iii. Please contact David Kruse at (385) 566-7789 or dbkruse@utah.gov for assistance regarding nitrate monitoring and reporting requirements. 3. The source water monitoring requirements intend to ensure equivalent protection for public health. 4. You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal prior to February 23, 2026. a. Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued. 5. This Temporary Exception may be rescinded at any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this exception. A dormant deficiency (code S013) will be added to your water system related to “Well lacks the required well seal” to track the expiration date of this exception.
