I have talked with a senior project manager her at DEQ. He agrees with the assessment that the round red ring is the base for the dispenser. He has stated that each dispenser would have been set directly over a single tank. The latter helps to confirm your ground penetrating radar investigation of potentially two more tanks. He also felt that the concrete in the center of the ring indicated the tank had been closed with concrete. He probably is right on this last point as well; however, I will have to do some more research when time permits in order to determine if the bottom of a dispenser was open to the inside of tank. At this point in time, this office will open a notification for this property as a property that has tank(s). At this time the tank will be considered a pre-74 tank that appears to be properly closed and will not be subject to notification to this office, underground tank fees, upgrade requirements, corrosion protection and release detection. Under state and federal rules, as long as the tank remains in place and verifiable contamination is not reported, then the tank is exempt from having to be removed. Ifthe tank(s) are removed then a property owner would be required to report any contamination, cleanup the contamination and proper tank removal. DERR Scientist: Bruce Hagans The property location is a comer lot with an older building which is currently being used as a residence. The building appears to be a former coirmiercial/retail building. There were no visible UST fill spouts, vent lines or dispensers. The area is rural and residential properties surround the comer property. Based on the style of the surrounding residential buildings, they appear to have been constmcted through-out the past 20 years or later. According to Bonnie and Jim: 1. Both have health problems as do their ctirrent and past pets. 2. Have lived at the property for some years. 3. There used to be dispensers in front of the building. 4. Neighbors indicate that gasoline was sold from underground tank(s) at the comer location. 5. Want to purchase the property. I explained: 1. Without physical evidence like vent lines, product piping and fill spouts, the DERR would not able to pursue ownership of or determine potential enforcement parameters for any USTs. 2. If UST(s) were found at the property and depending on when they were last used, the UST(s) may be allowed to remain in the ground provided that any known contamination was not impacting other properties. 3. If UST(s) were found at the property and were voluntarily removed by the property owner, then the UST(s) could be regulated by this office if gasoline/diesel were commercially sold. 4. If Boimie or Jim were able to provide evidence of a UST(s) or product piping, the DERR could then evaluate what regulations may apply to the UST(s). 5.
