RE:Evaporation Pond Corrective Action Plan (CAP) Groundwater Quality Discharge Permit Number UGW450005 (GWQDP) –CAP Closeout and Permit Modification
Dear Mr. Anderson:
The Division acknowledges the receipt of EnergySolutionsDecember 14, 2023 letter notifying the Division that the inspection and repairs of the upper liner of the 1997 and Mixed Waste
Evaporation Ponds, and repair of previously identified defects in the upper liner of the 1997, Mixed Waste, 1995, 2000, and Northwest Corner Evaporation Ponds were completed on October
24 and 25, 2023 (DRC-2023-078622). The completion of these repairs concludes the corrective actions required by EnergySolutions at this time per the Evaporation Ponds CAP submitted on
June 1, 2023 (DRC-2023-066048).
In the partial approval of the June 2023 CAP, EnergySolutions committed to the replacement of both the 1997 and Mixed Waste Evaporation Ponds by June 1, 2028 (DRC-2023-071744, DRC-2023-072638);
the approval of this replacement timeline shall be recorded in the upcoming Groundwater Discharge Permit modification.As per the Division’s partial approval, if the 1997 and/or the Mixed
Waste Evaporation Pond would exceed the allowable leakage rates for longer than 2 weeks before this time, the upper liner replacement shall be completed within 12 months from the date
of the first exceedance. EnergySolutions shall submit a CAP to replace the leaking liner within 90 days, including contractor contact information and anticipated dates of repair, and
shall complete liner replacement within the remaining nine months, not to exceed 12 months from the leakage exceedance. As a reminder, if both ponds require replacement of the upper
liner during the same time period (e.g. winter 2024), EnergySolutions shall replace both liners within their respective 12-month timeframes.
