Subject:Temporary Exception to R309-515-7(7)(e), Spring Fencing for School House, Hamongog, and Birch Springs (WS005, WS006, & WS008); Lehi City Water System, System #25015, File #13624
This Temporary Exception Expires on March 10, 2027.
Dear David Norman:
On February 7, 2024, the Division of Drinking Water (the Division) received your request for an exception to Rule R309-515-7(7)(e)regarding spring fencingfor the School House, Hamongog,
and Birch Springs. According to this rule, the spring collection area shall be surrounded by a fence located a distance of 50 feet (preferably 100 feet if conditions allow) from all
collection devices on land at an elevation equal to or higher than the collection device.
These exception requests for the fencing requirement were submitted because the springs are on City-owned property that cannot be used for grazing and public access to the spring area
is restricted by a locked gate. Also, the springs are located in a remote area with steep terrain making it difficult to install and maintain fencing around the spring collection areas.
The School House, Hamongog, and Birch Springs are identified as WS005, WS006, and WS008, respectively in the Division’s database.
Exception Request
The basis for your request for an exception to R309-515-7(7)(e) is that the spring collection areas are located in a remote area with steep terrain making it difficult to install and
maintain fences in these areas.
You propose that the current conditions of the spring collection area will provide equivalent protection for public health to meet the intent of the rule.
On this basis, exceptions to R309-515-7(7)(e), Spring Fencing, are hereby granted for School House, Hamongog, and Birch Springs (WS005, WS006, & WS008).
This Temporary Exception expires onMarch 10, 2027.
You will be required to re-submit an exception request along with confirmation that all conditions outlined in this temporary exception have been fulfilled and obtain an exception renewal
prior to March 10, 2027.
Exceptions granted by the Division include an expiration date to ensure that the basis and conditions for granting the exception are verified periodically and that the drinking water
quality remains protected. After receiving your request, the Division will determine whether this exception can be re-issued.
Failure to request the re-evaluation of this exception and obtain an exception renewal by March 10, 2027, will result in the activation of the deficiency related to not having spring
fencing.
This Temporary Exception may be rescinded any time if new evidence indicates that the conditions of this exception are no longer being met or a public health risk exists due to this
exception.A dormant deficiency (Code SS02) will be added to your water system related to “Spring Collection Area Not Fenced” to track the expiration date of these exceptions. An updated
IPS report is available at https:\\waterlink.utah.gov. Please contact Jennifer Yee at (385) 515-1501 or jyee@utah.gov for questions related to your water system’s IPS report or deficiencies.
Please maintain a copy of this letter with your permanent records for future reference.
