Dear Mr. Lewis:
The file for this release has been reviewed by the Division of Environmental Response and
Remediation (DERR) project manager who has recommended that no further corrective action be
taken at this time. This no further action applies only to the specific Release Site OJO. This
recommendation is based on information contained in the file for the release. That information was
supplied by you, your consultant, or another representative.
The information submitted indicates that any detectable petroleum contamination from this
release is not a threat to human health or the environment according to Utah Admin. Code rule
R311-21 l. In the future , if other evidence indicates the presence of contamination from either of
these releases which may cause a threat, further corrective action may be required .

SUBJECT: Transfer of all hard copy information to a closed PST case file

I have reviewed the file for the Pilot Thomas Logistics, #140 (PTL) petroleum release, including
information obtained by the Division of Environmental Response and Remediation (DERR). My
recommendation for no further action (NFA), at PTL OJO
in its case file. I recommend that no Leaking Petroleum Storage Tank (LPST) file be maintained other
than the UST database LUST module file, and that all hardcopy information be filed in a closed LPST
case file. Because a Reporting and Remediation compliance schedule was sent to the responsible
party, a NFA letter will be sent. This recommendation for closeout is based on the fact that a diesel
spill event, attributed to a delivery hose detachment from a fuel truck, was abated and cleaned up
within twenty-four hours.
File information justifying no further action includes the following: On December 17, 2023, a diesel
spill event was called into the DERR by Aric Morton, Broadbent & Associates, Inc. Reportedly, a fuel
delivery truck, Savage Trucking, LLC, had a delivery hose on the truck-end of the fuel transfer, detach,
spilling an estimated 40-gallons of diesel fuel. On-site PTL personnel placed adsorptive material over
the spill, called the Roosevelt Fire Department and the Enviro Care response company. The fire
department advised that off-site utilities were not affected. The spill did enter an on-site storm drain
with sump, and a vacuum truck company removed collected diesel. For the spill at large, the adsorptive
with the excavation monitored with an organic vapor monitor. Up to 3 roll-off containers were used to
store the abatement waste, and about 3 cubic yards of asphalt and soil were removed. All waste was
disposed at the Clean Harbors-Grassy Mountain Facility, EPA ID #: UTD991301748. The
recommendation for no further action at PTL is appropriate, as the noted diesel spill was cleaned up
within twenty-four hours, was observed by the local fire authority, and does not present a threat to
human health or the environment.
