Subject: Notice of Violation for Arsenic, Public Notice Requirement, Desert Oasis SSD:
UTAH14051
Dallas Anderson:
This letter is an official notification that according to the Division of Drinking Water (the
Division) records, the Arsenic Plant (identified as TP003 in the divisions database) is in violation
of the Arsenic standard as given in R309-200-5. Compliance with the Arsenic maximum
contaminant level (MCL) of 0.010mg/L is based off the running annual average (RAA). The
current RAA of Arsenic at the Arsenic Plant (TP002) is 0.011mg/L.
As a result of this violation, Deseret – Oasis SSD has been given an additional 50 IPS points.
Deseret – Oasis SSD now has 190 IPS points. Your system is now above the Improvement
Priority System threshold of 150 points and can now be rated Not Approved. To avoid this please
reach out to Colt Smith at acsmith@utah.gov or 385-515-1529 and request a Compliance
Agreement Enforcement Order within 14 to 30 days.
With the Arsenic Plant (TP003) containing combined Arsenic levels above the MCL, you must:
1. Notify your water users per the attached public notice protocol within 30 days of receiving
this letter and repeat the notice every three months for as long as the violation exists. A
copy of the public notice must be submitted to the Division at ddwreports@utah.gov by
December 21, 2023.
2. Enact one of the following mitigation measures:
a. Identify operational strategies that can minimize Arsenic exposure.
b. Identify possible alternative sources for drinking water.
c. Immediately implement an operational plan to minimize Arsenic exposure of the
drinking water.

3. Present MCL exceedance in annual CCR while including the Standard Health Effects
Language listed in R309-220-15 for Arsenic, and explaining the corrective actions being
taken.
