Shelley Executive Director DIVISION OF DRINKING WATER Tim Davis Director November 2, 2023 Jack Lytle Dutch John Town Water System PO Box 193 Dutch John, UT 84023 Subject: Notice of Violation – Dutch John Town Water System Failure to Report Flaming Gorge WTP (TP001) Monthly Surface Water Treatment Report, UTAH 05001 Dear Jack Lytle Division records indicate Dutch John Town Water System is in violation of the State of Utah Public Drinking Water Rule R309-215-8, as follows: As a surface water treatment system Dutch John Town Water System is required to report monthly system monitoring compliance for the Flaming Gorge WTP (TP001). Dutch John Town Water System failed to report the Flaming Gorge WTP (TP001) surface water treatment compliance monitoring to the Division for September 19 through September 26, 2023. This violation results in the addition of 50 Improvement Priority Points to Dutch John Town Water System’s Improvement Priority System Report (R309-400-5) as summarized below. •Violation Type 10 (50 points) – Operations Report - System fails to meet reporting and recordkeeping requirements [R309-215-8] (September 2023) Return to compliance and removal of IPS points will be achieved by demonstrating two months of compliance through monthly Surface Water Treatment Reports. If this letter is in error, please send appropriate documentation to Sarah Page at sepage@utah.gov as soon as possible within 30 days. Upon receipt of the results, we will resolve the violation and remove the points from your system’s IPS report. This is a Tier 3 violation. You must notify all consumers within one year of the violation according to R309-220-7. This public notice requirement cannot be waived once a violation has occurred. Public notification must be designed to reach all users. Water systems are to use, at a Jack Lytle Page 2 of 2 November 2, 2023 minimum, one or more of the following forms of delivery: broadcast media (such as radio and television), posting notice in a conspicuous location throughout the areas served by water system, hand delivery, or another delivery method approved in writing by the director. A copy of the notice you send to each customer must be provided to the Division. Please refer to the enclosed example of a public notice. The Division must approve the notice before it is distributed. The Division understands this violation is the result of a SCADA failure. We encourage Dutch John Town Water System to consider other means of backup and data archiving to ensure compliance. General records retention requirements can be found in R309-105-17, and records retention requirements specific to surface water treatment can be found in R309-215-8 and R309- 215-9.
