BENJAMIN RUSTY MUSSELMAN:
Our records show this water system is in violation of the State of Utah Public Drinking Water
Rules. The Division of Drinking Water (the Division) is missing analytical results for the
following analytes and compliance periods in 2023:

Failure to collect these samples is in violation of Utah Administrative Code Rule 309-205.
The violations result in the addition of points to this system’s Improvement Priority System (IPS)
report for each missing sample and could adversely affect this water system’s rating (see R309-
400).
In accordance with R309-205-6(1), community water systems that serve a population greater than
3,300 persons shall collect two pesticide samples in two consecutive quarters every three years.
Due to a display issue on systems monitoring reports found on waterlink.utah.gov, the second
pesticide sample requirement was not made clear. A one-time extension was given to systems that
did not collect their second pesticide sample by December 31, 2022 during the 2020 through 2022
three-year compliance period. Through the extension, systems were allowed to fulfill the sample
requirement by collecting the second pesticide sample any time before July 31, 2023.
According to our records, the system has not submitted a second pesticide sample collected from
the listed facility to the Division by July 31, 2023.

To resolve this violation, please collect the missing sample as soon as possible within the next
30 days. Upon receipt of results, we will resolve the violation and remove the points from the
system’s IPS report. Additionally, please notify the Division if this letter is in error.
In accordance with the public notice requirements given in R309-220-7, GRAND WATER AND
SEWER AGENCY must notify all its consumers of this violation within one year after the date of
this letter. Please reference the enclosed public notice template for guidance. Community water
systems must provide notice using one or more of the following methods:
•Mail or other direct delivery to each customer receiving a bill and to other service
connections to which water is delivered.
•Another method reasonably calculated to reach other persons regularly served by the
system (house renters, apartment dwellers, university students, nursing home patients,
prison inmates etc.).
A copy of the notice you send to the system’s consumers must be approved by the Division.
Please send a copy of the notice to the Division at ddwreports@utah.gov and
dbkruse@utah.gov prior to issuing the notice.
