Right-of-way (ROW): WSP is working with the city traffic control representative to obtain the final approvals to proceed and permit to operate (drill and install wells and allow future monitoring, etc.). Expected to be obtained in 5 – 10 days. WSP has driller tentatively scheduled for 10 days out (I think a week from Monday – week of March 25th) 2. DS Investment property (Advanced Metals Finishing & 3D Storage - Chris Holder): WSP shared GE’s access agreement with Chris Holder. He indicated to WSP that he would need take to the DS investment board for their review/approval. WSP & I will follow-up with Chris Holder next week to check on status. Note: if Chris Holder has reserves on allowing GE-WSP access, we may ask for you and Bill’s for support to have a call with Chris explain the purpose for the DERR request for additional off-site MWs (as you and Bill did for the 2 wells on their property installed in 2022 - TBD) 3. Accurate Cut Carbine, Lee Nielsen Property: This is the private property located directly south of the Advanced Metal Finishing property. GE is finalizing the access agreement and we are trying to find their contact details. If we get DS Investments authorization on the access agreement we will move the drill rig over to this property when the ROW is completed (or may need to re-mob if approvals form DS Investments is delayed). Brad will contact you/us with the proposed field mobilization dates for ROW, accordingly. Leigh, do you have any comments to the GE Site Management Plan (SMP) or Environmental Covenant (EC) you can share? We understand that these will not be “approved” or final, but your comments will help us understand what will need to be adjusted (as necessary) to obtain the upcoming closure (CoC). As for the SMP, I think I mentioned before that I only really had some minimal comments on the SMP for now. One of those comments was being unsure if the semi-annual monitoring was every two years or twice a year, which you clarified to me over phone call that it was the later. Another comment was about adding more sections to the inspection form including whether land use is the same or if there's been developments in areas over the plume, and a section specifically about inspecting any concrete cover or cap over petroleum or chlorinated solvent contamination (thickness, damage, maintenance work etc.) For the EC, I do have comments that I passed on to our legal counsel, but you can see how it would be best for me to have comments back from our legal counsel before I can send you anything about the Environmental Covenant. At the stage we're in I don't know that we're quite ready to push on the EC since I'm going over the recent data compared to the plume analytics you gave us and the 1,4 Dioxane Memo we received, and we have this next sampling also to conduct. I do think the next sampling should give us the information we need to make some final decisions about the SMP and EC though, so the comments that I do have now may be altered or added to when I see that new data as well. I'll keep coordinating with you in regards to where we are on these matters. I don't want to lose sight of the path we have been discussing which is to delineate the nature/extent, evaluate the risk and assess a remedy for groundwater. The EC and SMP are tools used with a remedy, but may not be the only components of a remedy. We are not at that point, but hopefully the next set of data (off-site) allows further progress toward that goal. As I have noted in previous discussions, I encourage GE to continue with groundwater monitoring as we have been conducting, until a final groundwater remedy is implemented and an SMP/EC accepted. We have reviewed the data from the December report and have some concerns that the 1, 4 dioxane concentration could be increasing in well MW-3. We will be in touch soon relative to the 1,4 Dioxane memorandum. The driller will use the GE property as a laydown and storage area.
